Terms and Conditions for Navarino Villa Apartment
These Terms and Conditions set out the basis of the contract with ‘Jonathan & Susan Collins’, none of which affect your statutory rights. When booking the apartment you enter into a contract with Jonathan & Susan Collins. References to “you” or “your” mean the person making the booking ‘The Party Leader’ and all members of the holiday party who have been accepted, will all be bound by these Terms and Conditions.
Your booking is made as a consumer and you agree that, no liability can be accepted by Jonathan & Susan Collins, for any expenses, costs, losses, claims or other sums of any description, which relate to any business, howsoever suffered or incurred by you. When we issue a written confirmation to you and your remittance has cleared, it is deemed that we have entered into a contract with you, which is subject to these conditions.
Booking & Payment
The Party Leader must be at least 18 years of age at the time of booking. Booking is simple through the Navarino Villa Website using PayPal. Full payment is required to secure a booking which is made less than 6 weeks before your stay. If a booking is made more than 6 weeks before your stay a 50% deposit will be required to secure a booking and a request for the remaining balance will be sent to you 4 weeks prior to you stay. Please call us on 01983 – 853473 for details. Once your on-line booking has been received together with payment, confirmation will be sent by e-mail detailing your booking. Any special requirements must be requested in writing prior to making a reservation and payment. We cannot accept liability for any loss or inconvenience in the event the apartment is not considered suitable for those with any specific needs. When you receive confirmation, the details should be checked carefully. If any of the details are incorrect you should advise Jonathan or Susan immediately.
If you cancel your booking
If you cancel your holiday less than 4 weeks before the commencement date of your holiday, 75% of your payment will be refunded. Once your booking confirmation is issued, a binding contract has been made between you and Jonathan & Susan Collins. If you have to, or wish to, cancel your booking, the Party Leader must telephone Jonathan or Susan as soon as possible. The Party Leader must also confirm the cancellation in writing. The day we receive your written notification of cancellation is the date on which your booking is cancelled, any funds will be returned to you within 10 working days.
If you change your booking
If you wish to change your booking once your confirmation has been issued, an administration fee of £50.00 will payable to us by you, once any changes have been made. If the change to your booking is not possible to make and you are unable to honour the confirmed booking, cancellation terms will apply. Your request for a change of your booking must be stated in writing to us.
If your holiday is cut short (Curtailment)
Should your holiday be cut short for what ever reason, resulting in you vacating the property sooner than the expiry of the agreed term, we shall not be liable to pay any refund of rent or fees to you in respect of the booking, or any costs incurred by you as a consequence of the curtailment of your holiday. We recommend you insure your booking with a cancellation and curtailment policy.
Cancellations or changes to your booking
In the unlikely event that your booking is significantly changed or cancelled, Jonathan & Susan Collins may consider the possibility of negotiations pertaining to any compensation if deemed appropriate. However, compensation will not be considered where any change or cancellation results from ‘Force Majeure’ or where you have refused, without good reason, to accept any significant change you may have been offered.
‘Force Majeure’ – Except where otherwise expressly stated in these Terms and Conditions, Jonathan & Susan Collins shall not be liable, jointly or individually, for any changes, cancellations, effect on your holiday, loss or damage suffered by you or any failure by us to perform or properly perform any of their respective obligations to you which is due to any event/s or circumstance/s beyond the reasonable control of Jonathan & Susan Collins, referred to as ‘force majeure’ in these Terms and Conditions. By way of an example only, ‘Force Majeure’ includes fire, flood, exceptional weather conditions, epidemics, destruction or damage of the property by any cause (other than negligence of Jonathan & Susan Collins) and all similar situations. In appropriate cases (for example when your booking has been cancelled under the aforementioned and similar circumstances before your departure) No compensation, expenses, costs or other sums of any description will be payable in such circumstances by Jonathan & Susan Collins.
Cancellations to your booking by Us
In the unlikely event of a cancellation of your booking by Jonathan & Susan Collins we will contact the Party Leader immediately, by telephone of the cancellation, explaining why. If a cancellation of your holiday is made by Jonathan & Susan Collins, you will receive a full refund of all monies paid to us.
Changes to your booking by Us
In the unlikely event of any changes to your booking by Jonathan or Susan Collins we will notify you as quickly as possible by telephone. If you choose not to accept the changes we will issue you a full refund. In the event that the Party Leader fails to advise us of the decision to accept or decline any change made by Jonathan & Susan Collins, we are entitled to presume your wish to cancel your booking and receive a full refund of all monies paid to us. Both the Party Leader and Jonathan & Susan Collins agree to confirm any such telephone conversations made to the respective party detailing the nature of the communication and any invitation, offer, acceptance or agreement.
Arrival & Key Collection
You will be advised, on your Booking Confirmation, of all arrangements pertaining to the collection and issuing of keys and times of arrival. We welcome our guests on arrival, give a brief tour of the rental apartment and it’s facilities if you wish and answer any questions. We respect the privacy of our quests whilst staying in our property but if any advice, information or help is needed, we are happy to assist. There is a Property Information File in the apartment which explains all the facilities the accommodation offers.
Your Stay in Navarino Villa Apartment
Every effort is made to make your stay an enjoyable one. Jonathan & Susan are on call should you experience any difficulties with anything pertaining to the apartment. Occasionally fixtures, fittings, equipment and appliances may require remedial work in the event of a failure or breakdown. It is essential that you contact us in the first instance at your earliest possible opportunity, whilst you are in residence, to report any failure or breakdown observed. We will respond to any such report as soon as possible with a view to instructing remedial works to limit any inconvenience that may be caused to you during your stay in the apartment. Complaints made by you of a transient nature about cleanliness, heating, etc, after the term of your occupation of the property, cannot be investigated by us.
Jonathan & Susan Collins will not accept liability for any death or personal injury or loss, during the term of your stay in Navarino Villa Apartment, however arising. You must purchase your own holiday insurance for the duration of your holiday. You must ensure that you take all necessary steps to safeguard your personal safety and possessions.
Jonathan & Susan Collins acknowledge their legal obligation to ensure that the apartment complies with safely regulations and we agree to have the apartment and its installations inspected by the appropriate qualified persons.
We are a pet friendly holiday rental apartment and we welcome your furry friends. There are many enjoyable walks on the Island and if you plan to bring your dog with you we’re sure they will enjoy them too. Your pet is a member of your family and we do understand that sometimes it’s not always possible to take them everywhere with you while you are on your holiday. With this in mind, we are happy for you to leave your pet in the apartment for a short time, if you feel they will be happy, and are able to cope on there own. However if you know your pet cannot be left alone, Please do not leave them unattended at the property. Please be aware that you are booking an apartment. Some dogs can become distressed resulting in persistent howling and barking and damage can also be caused to property by a distressed animal. If the apartment or any of its contents are found to be damaged, the responsibility for compensating Jonathan & Susan Collins for remedial works or replacement of goods will be yours.
Linen & Towels
Linen and towels are provided by us. Please bring your own beach towels.
If you have any special requirements such as a cot or highchair, please let us know when you place your booking or shorty afterwards.
Electricity & Water
The apartment includes the use of mains services.
Mobile phone services are patchy in Ventnor. Please consult with your mobile phone provider to check mobile phone coverage in Ventnor.
Television & WI-FI
Sky Satelite television is installed in the apartment, along with WI-FI.
Please vacate the apartment and return all keys by 10.30am on the expiry date of the term of your booking.
Damage to the apartment
Please leave the apartment in a good state of cleanliness, similar to that as found at the time of taking occupation. Whilst we accept accidents and breakages do happen, please report these when they take place. If, following your vacation, the apartment or any of its contents are found to be damaged, the responsibility for compensating Jonathan & Susan Collins for remedial works or replacement of goods will be yours, any costs will be invoiced and sent to you payable within 10 days of its date.
We aim to keep Navarino Villa website current and up to date at all times. Every effort has been made to ensure that the descriptions convey an accurate account of Navarino Villa Apartment.
Data Protection / Confidentiality
We do not store customer data in any form, except what is required by law for Income Tax calculations by our Chartered Accountant.
We do not share customer information with any other person or persons in any form except when required by law.
